1 – SCOPE OF APPLICATION
1.1 – These general terms and conditions of sale (hereinafter “GTC”) apply to all orders placed by any person (hereinafter “you”) with the company (hereinafter “INTERPRESTIGE | KOOL BEAUTY”) in their version in force at the time of the order.
The validation of your order implies acceptance of the GTC.
All deliveries and services are governed exclusively by these GTC, unless otherwise agreed, expressly and in writing.
1.2 – The term consumer as used in these GTCs shall mean a natural person placing an order that is not part of his or her professional activity.
The term working day as used in these GTCs shall mean all days of the week except Saturdays, Sundays and public holidays.
1.3 – INTERPRESTIGE reserves the right to modify its GTC at any time and without prior notice.
2 – CONSULTATION OF THE SPECIAL PROVISIONS
2.1 – You can consult these GTC at any time on our website www.koolbeautyparis.fr. You can print or save this document. The contractual terms and conditions of your order are included in the order confirmation e-mail that will be sent to you automatically at the e-mail address you have provided.
2.2 – The data you have registered when creating your account is protected by a password. You undertake not to divulge this password to a third party. You can at any time consult your account data, query your current or previous orders, current or previous deliveries and modify your personal data.
3 – PRODUCTS AND AVAILABILITY
3.1 – The products presented on the site are available within the limit of stocks.
The order and the delivery are validated only by the sending of an e-mail of confirmation by our care from the address.
3.2 – The products presented are photographed and described as accurately as possible. Depending on the internet browser and/or the screen used, the colours may not be true to life.
4 – HOW TO MAKE A PURCHASE
4.1 – The user who wishes to purchase a product from the online shop must :
- Fill in the identification form with all the required information. A login and a password will be requested.
- Select the product(s) at the desired frequency (if subscription),
- Confirm the order, the order becomes final when you click on “place order”.
- Make the payment in accordance with the conditions
- We will acknowledge receipt of your order by sending an order confirmation to the address you have provided
4.2 – Any placing of an order implies your acceptance of the prices and description of the products you have placed in your basket
4.3 – We reserve the right to cancel or refuse any order from a customer with whom there is a dispute over the payment of a previous order or who presents any suspicion of fraud.
5 – RATE
5.1 – The prices of the articles are indicated in Euros, excluding shipping costs. These are indicated by default in VAT and duties included.
5.2 – Delivery to Metropolitan France and the European Union: Rate applied: All taxes included (TTC). VAT rate 20%.
- Delivery to DOM TOM: Rate applied: exclusive of tax (HT). VAT and other duties are to be paid by the recipient to the customs authorities of the place of delivery.
- Delivery to countries outside the European Union: Rate applied: Duties and taxes included. No duties are due to the customs services of the place of delivery. They are paid by the sender, the company INTERPRESTIGE. The products will be invoiced on the basis of the tariffs in force at the time of order registration.
5.3 – INTERPRESTIGE reserves the right to modify its prices at any time, it being understood that the price applied to the consumer is that corresponding to the day of validation of the order.
6 – SHIPPING
6.1 – Deliveries are made to the address indicated on the order form.
You must provide all the information you consider necessary: access code, floor, presence of a guard. In the event of an error or inaccuracy in the buyer’s details, we cannot be held responsible for the impossibility of delivering the order.
6.2 – For Metropolitan France, Andorra and Monaco, our deliveries are made by Colissimo at a rate of 5.40€.
For countries outside France and the EU, delivery will be made by the carrier to the address you have indicated and will be at a cost of 25€.
Deliveries are made to the address indicated on the order form. You must provide all the information you consider necessary: access code, floor, presence of a caretaker. In the event of an error or inaccuracy in the buyer’s details, we cannot be held responsible for the impossibility of delivering the order.
6.3 – Delivery problems :
If the original packaging is damaged, torn or open at the time of delivery, we advise you to note the words “with reservations + reason(s)” and to check the condition of the item(s), or to refuse the parcel with the words “refused because open or damaged” on the carrier’s delivery slip. You then have three days to notify our company. You must give a detailed description of the problem found (for example: damaged package, already opened…)
In case of non-delivery of the parcel within the time announced by the carrier, you must inform us as soon as possible. We will then open an investigation with the services concerned and we will do everything possible to ensure that the waiting time is reasonable.
6.4 – We undertake to deliver the goods ordered on the site within the period, expressed in working days, which will be displayed in the summary of your order and in the order confirmation e-mail.
7 – TERMS OF PAYMENT
7.1 – The price is payable at the time of ordering and in one go.
7.2 – Any attempt to defraud, for whatever amount and from whatever source, will be subject to criminal prosecution
7.3 – The payment of the order will be made either by :
- Credit Card(CARTE BLEUE)
- Credit Card (VISA, MASTERCARD, AMERICAN EXPRESS)
- PAYPAL
The payment is secured by the CIC bank, equipped with a security device: the 3D secure programme, with an authentication request at the time of payment, in order to limit the fraudulent use of a card number on the Internet without the owner’s knowledge.
8 – RIGHT OF CANCELLATION
8.1 – The customer has a period of fourteen clear days from the day of receipt of the product to exercise his right of withdrawal and to return the goods. The returned products must be in their original state, unused, in their packaging and in blister packs. Upon receipt of the package, Interprestige will judge the perfect condition of the returned goods. No return will be accepted if the returned products have been visibly used or damaged by the buyer and that this use or damage makes the products unfit for sale. If the return is refused, the products will be returned to the buyer at our expense without the customer being able to claim any compensation or right to reimbursement. If the customer withdraws within the given time limit, INTERPRESTIGE undertakes to reimburse the customer for all sums paid, with the exception of the return costs, which will be borne by the customer.
9 – RESPONSIBILITIES
9.1 – In the online sales process, INTERPRESTIGE is only bound by an obligation of means; it cannot be held responsible for any damage resulting from the use of the Internet such as loss of data, intrusion, virus, breakdown of service, or other problems beyond our control.
10 – INTELLECTUAL PROPERTY
10.1 – All elements of the INTERPRESTIGE | KOOL BEAUTY website are and remain the exclusive intellectual property of INTERPRESTIGE. No one is authorised to reproduce, exploit, distribute or use in any way whatsoever, even partially, the elements of the site, whether they be software, visual or sound. Any simple link or hypertext link is strictly forbidden without the written consent of INTERPRESTIGE. Any total or partial reproduction of INTERPRESTIGE’s websites is strictly forbidden without prior agreement.
11 – PROTECTION OF PERSONAL DATA
11.1 – We record the data you provide when you place an order. The automated collection and processing of this data concerning you is necessary for the management of your order and our commercial relations. They may be transmitted to companies that contribute to these relations such as those responsible for the execution of services and orders for their management, execution, processing and payment. This information and data is also kept for security purposes, to comply with legal and regulatory obligations and to enable us to improve and personalise the services we offer you and the information (e.g. product offers) we send you.
12 – ARCHIVING, EVIDENCE
12.1 – INTERPRESTIGE shall archive the order forms and invoices on a reliable and durable medium constituting a true copy, in accordance with the provisions of Article 1348 of the French Civil Code. The company’s computerised records shall be considered by the parties as proof of communications, orders, payments and transactions between the parties.
13 – APPLICABLE LAW
13.1 – The contractual relationship between us and our consumer customers is subject to French law.
